General Terms and Conditions (GTC)
for Orders via the Webshop of TimeTeller GmbH

§1 Scope and Definitions
(1) These General Terms and Conditions (hereinafter referred to as “GTC”) apply exclusively to all orders placed through the online shop of TimeTeller GmbH at www.timeteller-health.com, in the version valid at the time of the order.
(2) We do not accept any terms and conditions of the customer that deviate from these GTC unless we have expressly agreed to their validity in writing.
(3) A “consumer” within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that predominantly are outside his or her trade, business, or profession. An “entrepreneur” is any natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of his or her trade, business, or profession.
§2 Contracting Party, Conclusion of Contract, and Storage
(1) The contracting party is:

(hereinafter referred to as the “Provider”).
(2) The customer may select products from the Provider’s range, in particular saliva-based diagnostic test kits for the analysis of the circadian rhythm and derivation of personalized health recommendations, and collect them in a virtual shopping cart using the “Add to Cart” button. By clicking on “Checkout,” the customer proceeds to registration or login into their customer account. After creating a customer account or logging in with an email address and password, the customer submits a binding offer to purchase the items in the shopping cart by clicking on the button “Order with Obligation to Pay.” Before submitting the order, the customer may review and amend the entered data at any time. The order can only be submitted if the customer accepts these contractual terms by clicking the button “Accept GTC,” thereby including them in the offer.
(3) The Provider will then send the customer an automatic order confirmation by email, which lists the customer’s order and can be printed using the “Print” function. This automatic confirmation of receipt merely documents that the Provider has received the order and does not constitute acceptance of the customer’s offer. The contract is concluded only upon the Provider’s express declaration of acceptance, which will be sent in a separate email (order confirmation). In this email, or in a separate email but at the latest upon delivery of the goods, the contract text (consisting of the order, these GTC including the withdrawal policy and model withdrawal form, and the order confirmation) will be sent to the customer on a durable medium (email or paper printout) (“Contract Confirmation”). The Provider will store the contract text in compliance with data protection regulations.
(4) Orders within the framework of the selective agreement with Techniker Krankenkasse require registration in the online shop and verification by means of the insured person’s policy number and date of birth. Under this selective agreement, the order is free of charge for the insured person but limited to one order per year. The insured person is responsible for reading the information on the TK website at https://www.tk.de/...time-teller-2203542, which outlines the terms of the selective agreement.
(5) The conclusion of the contract is subject to the reservation of timely and complete self-supply. This reservation does not apply in cases of short-term delivery disruptions or where TimeTeller is responsible for non-delivery, particularly if TimeTeller fails to procure supplies on time. The customer will be informed immediately if the product is unavailable. If payment has already been made, it will be refunded promptly.
§3 Prices, Shipping Costs, and Payment Terms
(1) All prices indicated include statutory value-added tax (VAT). Any applicable shipping costs are shown separately.
(2) Shipping costs are specified in the order form and must be borne by the customer unless the customer exercises his or her statutory right of withdrawal.
(3) Consumers may pay by credit card. TimeTeller reserves the right to restrict available payment options depending on order value, shipping destination, or other objective criteria.
(4) The purchase price and shipping costs are due immediately without deduction. If payment in advance has been selected, the customer undertakes to pay the purchase price promptly upon conclusion of the contract. If delivery is made by cash on delivery, payment is due upon receipt of the goods.
(5) Shipment of the test kits to the customer and subsequent shipment of the sample by the customer to TimeTeller shall be made by postal delivery. The risk of loss during shipment is borne by the Provider if the customer is a consumer. Analyses and recommendations are made available to the customer electronically in their customer account.
(6) In the event of a withdrawal, the customer shall bear the direct costs of returning the goods.
(7) The customer shall be liable for any additional costs arising from incorrect payment information.
(8) TimeTeller is entitled to use the services of trustworthy third parties to process payments:
a) In the event of the customer’s default in payment, TimeTeller may assign its claims to a debt collection agency and transfer the personal data necessary for payment processing to that third party.
b) In the event of the involvement of third parties in payment processing, payment shall be deemed made to TimeTeller only when the amount has been properly made available to the third party so that the third party can dispose of it freely.
§4 Delivery
(1) Unless otherwise stated in the product description, all items offered are generally ready for dispatch within two weeks.
(2) When ordering saliva analysis kits, the customer receives a test kit which must be used in accordance with the enclosed instructions for use within one month of receipt.
§5 Diagnostics
(1) The Provider shall analyze the sample and, as a rule, provide the diagnostic results and individual health recommendations electronically in the customer’s account for download within one month after receipt of the sample, and shall inform the customer by email.
(2) If the sample cannot be reliably analyzed due to non-compliance with the instructions for use, the customer’s entitlement to diagnostic analysis lapses. The Provider will notify the customer of this by email.
(3) In the event of loss or damage to the sample during postal transit, for which the customer is not responsible, the Provider will provide a replacement test kit at no cost.
§6 Retention of Title
Ownership of the goods remains with TimeTeller until full payment of the purchase price has been received. If the customer is a merchant within the meaning of the German Commercial Code (HGB), TimeTeller retains ownership of all delivered items until receipt of all payments arising from the business relationship.
For orders under the selective agreement with Techniker Krankenkasse, ownership of the goods transfers upon full payment of the purchase price by Techniker Krankenkasse.
§7 Warranty
(1) If goods purchased and delivered via our online shop are defective, the customer is entitled to the statutory rights of remedy, withdrawal, or price reduction.
(2) The limitation period for warranty claims for delivered goods is two years from receipt of the goods. For merchants, the limitation period is one year. Claims based on defects fraudulently concealed by us are subject to the regular statutory limitation period.
(3) Warranty rights also arise under any express quality or durability guarantees that we have explicitly provided in individual cases.
(4) Information, drawings, illustrations, technical data, weights, measurements, or performance descriptions contained in brochures, catalogues, circulars, advertisements, or price lists are for informational purposes only. TimeTeller assumes no warranty for their accuracy. The details in the order confirmation alone are decisive regarding the type and scope of delivery.
(5) Data communication via the internet cannot be guaranteed to be error-free or continuously available given the current state of technology. TimeTeller therefore accepts no liability for the continuous and uninterrupted availability of the online offering.
§8 Limitation of Liability
(1) The liability of TimeTeller is governed by statutory provisions unless otherwise specified in these General Terms and Conditions. TimeTeller shall be liable for damages, irrespective of the legal basis, only in cases of intent and gross negligence without limitation. Furthermore, TimeTeller shall be liable without limitation for damages arising from injury to life, body, or health caused by simple negligence.
In the case of simple negligence and the breach of a material contractual obligation (cardinal obligation), TimeTeller’s liability is limited to compensation for the foreseeable, typically occurring damage. Liability under the German Product Liability Act remains unaffected.
(2) Where TimeTeller’s liability is excluded or limited under these GTC, the same applies to the personal liability of TimeTeller’s employees, workers, staff, representatives, and agents.
§9 Right of Withdrawal
(1) Consumers are entitled to a statutory right of withdrawal when concluding a distance selling contract, about which the Provider informs below in accordance with the statutory model. Exceptions to the right of withdrawal are set out in paragraph (2). A model withdrawal form is provided in paragraph (3).

You have the right to withdraw from this contract within fourteen (14) days without giving any reason.
The withdrawal period is fourteen (14) days from the day on which you or a third party designated by you, who is not the carrier, took possession of the goods.
To exercise your right of withdrawal, you must inform us, TimeTeller GmbH, of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, which is, however, not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send the notification of your intention to exercise the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse all payments we have received from you, including delivery costs (except for additional costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event no later than fourteen (14) days from the day on which we receive notice of your withdrawal from this contract.
We will make the reimbursement using the same means of payment that you used for the initial transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees as a result of the reimbursement.
We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever occurs earlier.
You must return or hand over the goods to us without undue delay and in any event no later than fourteen (14) days from the day on which you informed us of your withdrawal from this contract. The deadline is met if you dispatch the goods before the period of fourteen (14) days has expired.
You will bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
(2) The right of withdrawal does not apply to orders placed free of charge under the Selective Agreement with Techniker Krankenkasse, where the costs are borne by the health insurance provider. The right of withdrawal is also excluded for test kits that were delivered sealed and whose seal has been removed after delivery.
(3) The Provider informs about the model withdrawal form in accordance with statutory provisions as follows:

§10 Contract Language / Place of Jurisdiction / Place of Performance / Applicable Law
(1) The contractual language is German.
(2) The place of performance for all deliveries is the registered office of TimeTeller GmbH in Hamburg.
(3) If the customer is a merchant within the meaning of the German Commercial Code (HGB), a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction shall be Hamburg. In such cases, TimeTeller is also entitled to bring an action against the customer at the customer’s place of residence. The same applies if the customer has no general place of jurisdiction in Germany, moves his or her residence or habitual abode abroad after conclusion of the contract, or if the customer’s residence or habitual abode is unknown at the time the action is filed.
(4) The contract governed by these General Terms and Conditions shall be subject exclusively to the law of the Federal Republic of Germany. The provisions of the United Nations Convention on Contracts for the International Sale of Goods (CISG) are excluded.
(5) Should any provision of these General Terms and Conditions be or become invalid or conflict with statutory provisions, the remainder of the contract shall not be affected.

1. Description of Service
TimeTeller is a project designed to translate new research findings into practical use. It investigates how our internal biological clock interacts with specific genes and how this interaction may influence the onset or progression of diseases.
TimeTeller aims to help individuals and healthcare professionals maintain health and prevent illness by providing knowledge and tools to better understand how the body functions throughout the day – known as “circadian rhythms.”
TimeTeller also seeks to improve the development and effectiveness of medicines by identifying optimal timing for drug administration, thus enhancing efficacy and reducing side effects.
2. Implementation of the Service
Through the TimeTeller webshop, customers can order a test kit to collect a saliva sample themselves. The sample is then returned by the customer to TimeTeller. TimeTeller performs a detailed analysis of the customer’s unique circadian rhythm and, based on the results, provides personalized recommendations for optimal sleep, nutrition, exercise, and more.
